RE: The tariff classification of a glass lamp shade from Mexico.

Dear Mr. Dominguez:

In your letter dated June 26, 1997, on behalf of Rooster Products, you requested a tariff classification ruling.

The sample submitted is a glass shade, designed for a hurricane lamp, which measures approximately 8 1/2 inches in height by 4 inches in diameter along both ends. It features, on its exterior, small rectangular-shape colored glass pieces that are adhered to the glass body via cement.

You claim that this merchandise should be properly classified under subheading 9405.50.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for other non-electrical lamps and lighting fittings. However, since lamp parts are specifically provided for elsewhere in the tariff, consideration of classification under the above subheading is precluded.

The applicable subheading for this glass lamp shade will be 9405.91.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for other glass lamp parts. The general rate of duty will be 12.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
